Terms of service

1. The agreement

These terms govern use of FreightBlast. A signed order form or an accepted online subscription, together with these terms, forms the agreement between you and Doft Inc.

3. Acceptable use

You may not use FreightBlast to send messages to people who have opted out, to impersonate another business, to make claims you cannot support, or to evade spam, carrier or provider filtering by rotating identities, domains, numbers or wording. These are grounds for immediate suspension, and the product enforces several of them rather than relying on this clause.

4. Our obligations

We provide the service with reasonable skill and care, keep the policy and consent controls described in the consent and law page in force, and give notice of material changes to them.

5. Fees and billing

Fees follow the pricing components described on the pricing page. The pricing version accepted at subscription is frozen onto your subscription and invoices; a change requires an explicit migration you agree to. Payments are processed by Stripe.

6. Suspension

We may suspend sending on a workspace where we have reasonable grounds to believe a legal, carrier or provider requirement is being breached. We will say what the grounds are.

7. Term and termination

Either party may terminate at the end of a subscription period. On termination we stop processing and purge customer data on the retention schedule in the privacy policy, except suppression records.

8. Liability

Neither party excludes liability that cannot lawfully be excluded. Subject to that, liability is limited to the fees paid in the twelve months before the claim, and neither party is liable for indirect or consequential loss.
